Sustainability claims

You come across them often, terms like sustainable or durable. Sustainability claims, which are not defined in the Claims Regulation.

In the Guideline on Sustainability Claims, the Consumer & Market Authority has drawn up some general rules for the use of these types of claims:

  • Be as specific as possible about your product's sustainability benefit. The claim should not be misleading or give the false impression that your brand is more sustainable than others in the same category. Absolute claims such as the only sustainable in the Netherlands are not allowed if other suppliers have similar products to offer. This was confirmed by the Board of Appeal last year in ruling No. 2020/00108-CVB.
  • Substantiate claims with the latest facts and keep them current. So don't use test results from 2010 to support your claims anno 2021.
  • Make sure comparisons with other products, services or companies are fair and specific.
  • Also, be honest and specific about your company's sustainability efforts.
  • Use only clear labels, symbols or images that help consumers make the right choice. Therefore, use only logos or symbols that reflect the standards for which a product is certified.
