On Oct. 2, it was announced that the European Commission has decided to delay the entry into force of the European Union Deforestation Regulation (EUDR, also known as the Deforestation Act) by one year. The decision must still be approved by the European Parliament and member states, but it is expected that a majority will vote in favor. However, it is still unclear if only the effective date will be delayed, or if there will also be changes to the content of the regulation.
Our assessment is that delay does not mean postponement. This implies that importers or traders of products covered by the EUDR would be well advised to start preparing during 2025 to meet all requirements in time.
What preparations can you make? The core of the EUDR, namely the establishment and maintenance of a due diligence system, remains in place, as we see with other sustainability legislation. Therefore, we advise not to wait too long, but to start thinking about how you can fulfill the due diligence obligation with a view to 2025. In very practical terms, this could mean, for example, drawing up a handbook with process and procedure descriptions, and organizing cooperation with suppliers properly.
