The General Product Safety Directive (GPSD) 2001/95/EC will soon be a replaced by a Regulation. The proposal for the General Product Safety Regulation (GPSR) was published by the European Commission on June 30, 2021.
GPSD's current purpose and role remains unchanged. GPSR also acts as a ''Safety Net'' to protect European consumers from unsafe products. A regulation at the European level ensures that product safety rules can be applied even more efficiently and consistently within EU member states. Better traceability and faster exchange of information on unsafe products, as well as the accommodation of new risks created by the growth of digital technology and online sales are covered by the GPSR.
The main difference between the GPSD and GPSR is that both the scope, as well as roles and obligations of different market participants, have been expanded.
New within the scope of the GPSR is the focus on digital technology, artificial intelligence, cyber security, online sales and food imitation products.
In addition to the well-known roles of market participants as manufacturers, importers and distributors, the GPSR now specifies the new roles and associated obligations for ''fulfillment service providers'' and ''authorized representatives.''
