Consumer product notification deadline postponed

In 2017, the CLP Regulation (EC) No. 1272/2008 was amended by adding a long-awaited annex to harmonize the notification of dangerous mixtures to the national poison control centers in the European Union. Not only was the creation of a central European antivenom center decided upon, the requirements for the information to be submitted were also harmonized.

Mixtures intended for consumer use should meet the requirements set out in Annex VIII by January 1, 2020. However, after a public consultation last summer, the CARACAL expert group decided in September to postpone the deadline to Jan. 1, 2021. It is expected to be finally adopted by the Council and the European Parliament later this year.

Main reasons for postponing the deadline are the concerns of importers and downstream users about the ambiguities surrounding the placement of the UFI codes on products and about the workability of the IT systems to be used. Many companies therefore expressed these concerns during the consultation round. The European Commission has now heeded them.

The other deadlines mentioned in Annex VIII do not change, so the previously mentioned dates by which the remaining products must comply with the Annex remain in effect:

  • Jan. 1, 2021: products for professional use
  • Jan. 1, 2024: products for industrial use

For products whose information has already been submitted to national poison control centers before the effective date, notification and labeling must be updated to the new regulations by Jan. 1, 2025.
